Stalking and harassment are defined as two separate criminal offenses under Massachusetts law.  Stalking may be defined as a willful and malicious pattern of conduct directed at a person that causes the person to experience annoyance, alarm and substantial emotional distress.  Making a threat against another person with the intention of placing that person in immediate fear of injury or death may also be described as stalking.  Harassment is a similar offense that involves much of the same acts as stalking, with the exception of placing the alleged victim in fear for his or her safety.

Stalking may be punishable by imprisonment for up to 2 ½ or 5 years, by a fine of up to $1,000 or by both fine and imprisonment.  Harassment may be considered a slightly lesser offense, punishable by 2 ½ years of imprisonment and/or a fine of up to $1,000.  Second or subsequent offenses, or stalking/harassment in violation of a restraining order will result in enhanced penalties and the enforcement of a mandatory term of imprisonment that cannot be reduced.
