Penalties For An Under 21 DUI Conviction
If you register at .02 percent blood alcohol concentration (BAC) or above and are under 21, you will be charged with a DUI. Your driver's license will be suspended for 30 days just for failing the breath test. Your license will also be revoked for 210 days if you are convicted. You will have to pay more than $2,500 in fines and court fees and will be required to take a 16-week alcohol treatment program (one day a week). You will be on probation for a year. If you registered at .20 percent or over, you will be required to attend a two-week inpatient alcohol treatment program. There are no hardship licenses available to those convicted of underage OUI.
How We Help
Your Boston underage OUI defense attorney will seek out every possible flaw in the case against you and will challenge any evidence that was procured without correct law enforcement procedure. You are likely frightened and concerned. The attorney understands your situation and can advise you of what to expect and what can be done to aggressively defend your case.
For example, a .02 percent BAC level is extremely low, one drink or less, and Breathalyzers are notoriously inaccurate in their readings, making it possible to get arrested and charged with this offense without ever taking a drink. Medical issues, problems with calibration of the device and what you've had to eat can make a Breathalyzer reading inaccurate. Our attorneys make sure that there were no factors affecting the accuracy of the Breathalyzer. If problems are found, we will seek to have the case against you thrown out.
