Our 18-Step Strategy

Our Complete Legal Defense Plan for Boston DUI and Massachusetts Criminal Defense Cases

If you are facing criminal charges in Massachusetts, the defense attorney you hire to fight for you is a critical decision. If you are like most people, you'll quickly find that some lawyers are general practitioners who take on criminal cases as an added side business to help them pay the bills. They do not have the requisite experience or background that you need to launch a strong criminal defense.

That is not what you'll find at the Massachusetts Criminal Defense Group. The defense attorneys on our team focus primarily on criminal defense. The result is such that we have developed powerful resources to build a powerful defense for our clients.

Take DUI-OUI cases as an example. Our resources include top expert witnesses, doctors, investigators, and former law enforcement officers. Each of us understands the science behind the breath test, blood test, and other aspects of the science behind Massachusetts DUI arrests.

The fee for our criminal defense includes top-notch representation and includes each of these 18 legal services for a flat fee . Here's what we'll do to fight for your case:

  1. Provide you with a free case evaluation and one-time consultation on your situation. We listen to what did and didn't happen, we ask the pertinent questions, and we assess the strengths and weaknesses of your case.
  2. Match your case with a team of criminal defense attorneys who concentrate on your types of cases.
  3. Assemble a complete legal defense team for your case. Even the smallest case that can be handled by a single lawyer is backed-up by our entire team approach — 24/7 case management, and a "brain trust" of expertise that your team can tap into for help at any time.
  4. We'll get a copy of the police report, any witness statements, and any pertinent evidence.
  5. We work for getting our client released from jail right away. Once we're retained, if needed, we will work with your loved one or friend to facilitate the release process.
  6. Each case gets our independent investigation . We review each aspect of your case – legal defenses, inconsistent statements, and the factual makeup of what really happened.
  7. We really scrutinize — line-by-line — all aspects of the arrest and actions of law enforcement. We concentrate on police actions and misconduct. We will review your case for lack of probable cause, invalid or unsupported search or arrest warrants, improper arrest procedures, uncalibrated breath testing devices, charges filed that are unsupported by evidence, and advise you on all options available to you.
  8. Our legal team will evaluate the chain of events leading up to and resulting in your arrest and detention. We're looking for improper adherence to procedure, handling of evidence, lack of probable case, and other criteria that may strengthen your defense.
  9. Within hours of being retained on your behalf, we'll typically visit the scene of your arrest. We comb for evidence and disproving factors while recording irregularities and any contradicting or conflicting statements cited in the police report.
  10. Throughout the entire process, we will help you feel informed, empowered, and educated. We make it a priority to keep you educated about your case. We update you at each step of the process as to your choices, your risks, and the potential benefits of each strategy, as they develop. You will never feel as though you don't know what's going on, what is coming next, or that you are not in control of what happens in your case.
  11. We retain our own private investigators and independent laboratories to test, and testify as to the reliability of the evidence presented by the prosecutor. It is amazing how powerful this can be in front of a Judge!
  12. Once you get a full commitment from us, research, writing, and arguing motions are included. Your fee also includes all of the drafting for your case, for example, motions to quash a search warrant, motions to suppress evidence, motions to compel the prosecution to turn over crucial discovery, motions to recover personal property, and more.
  13. We will meet with the prosecutor to determine if the case can be resolved in a different manner than first thought, with a favorable plea bargain for example.
  14. As a group, we diligently prepare for trial – even in those cases when we believe the case won't go that far. Does that mean we litigate all cases? No. But we are committed to the point that we'll prepare each case as if it is going to trial. We believe this preparation and willingness to go all the way leads to more favorable settlement offers from the prosecutor.
  15. Our preparation is such that we'll always prepare an opening statement for trial. We invite the Judge (or jury) to scrutinize every element of the Commonwealth's case, thus holding the District Attorney to their burden of proof.
  16. We aggressively cross-examine the prosecutor's witnesses at trial. Known as tireless in the courtroom, our attorneys will take every opportunity to emphasize their bias, lack of credibility, or inconsistent statements. Quite often, the Assistant District Attorney may argue that the police officer is not the one on trial, but that the defendant is. Our response is that anyone who testifies against one of our clients is on trial, because we put them on trial. The law allows us to do that, and we take advantage of this opportunity.
  17. We'll present a well thought-out closing argument at trial. We summarize the evidence in the case (or the lack thereof), and urge the fact-finder to return a verdict of not guilty.
  18. When we say we are available 24/7/365, we mean it. Those who call us over the weekend – or at three o'clock in the morning – often times receive calls back within minutes. If you choose to contact us online using our online form, we're just as responsive to your immediate needs.
